The U.S. 5th Circuit Court of Appeals has overturned a lower federal district court's ruling that found a section of House Bill 2, Texas new abortion law to be unconstitutional.
Starting Friday, Nov. 1 every clinic performing abortion will have to be staffed by doctors with admitting privileges at a hospital no more than 30 miles away from their facility.
In the 5th Circuit Court's opinion justices wrote:
"There is a substantial likelihood that the state will prevail in its argument that Planned Parenthood failed to establish an undue burden on women seeking abortions or that the hospital-admitting-privileges requirement creates a substantial obstacle in the path of a woman seeking an abortion."
In a statement released moments after the ruling was released, Attorney General Greg Abbott wrote:
"This unanimous decision is a vindication of the careful deliberation by the Texas Legislature to craft a law to protect the health and safety of Texas women."
